Terms of Service

1. Acceptance of Terms

By accessing this website or engaging BOMCAS Media for photography, videography, or livestreaming services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Services

BOMCAS Media provides professional photography, videography, video production, drone services, and livestreaming services across Alberta, Canada. Specific service terms, deliverables, timelines, and pricing are detailed in individual service agreements or proposals provided before booking confirmation.

3. Bookings and Deposits

• All bookings require a signed service agreement and a deposit of 25–50% of the total quoted price to confirm the date
• Deposits are non-refundable unless BOMCAS Media cancels the booking
• The remaining balance is due as specified in your service agreement (typically on or before the service date)
• Dates are not confirmed until the deposit is received and the service agreement is signed

4. Cancellations and Rescheduling

• Cancellations made more than 30 days before the service date: deposit forfeited, no additional charges
• Cancellations made 14–30 days before the service date: 50% of total contract value due
• Cancellations made fewer than 14 days before the service date: 100% of total contract value due
• Rescheduling is subject to availability and must be requested in writing at least 14 days in advance
• Funeral and memorial services have special terms — contact us for compassionate scheduling accommodations

5. Intellectual Property and Usage Rights

BOMCAS Media retains copyright in all photographs and video footage we create. Upon full payment of the agreed fee, clients receive a license for personal and commercial use as specified in their service agreement. This license does not transfer copyright ownership.

BOMCAS Media reserves the right to use images and video for portfolio, website, social media, and marketing purposes unless the client requests confidentiality in writing.

6. Delivery and Turnaround

Delivery timelines are as agreed in the service proposal. Standard timelines:

• Real estate photography: 24–48 hours
• Event photography: 7–14 business days
• Wedding photography: 4–8 weeks
• Video production: as specified in proposal (typically 2–4 weeks)
• Rush delivery is available at additional cost

7. Drone Services

All drone operations are conducted by Transport Canada Advanced RPAS certified operators. Drone services are subject to weather conditions, Transport Canada regulations, and airspace authorizations. BOMCAS Media is not liable for cancellation or delay of drone services due to weather, restricted airspace, or regulatory requirements beyond our control. We will make reasonable efforts to reschedule affected drone shoots.

8. Livestreaming Services

Livestreaming services are dependent on adequate internet connectivity at the venue. BOMCAS Media will use reasonable professional efforts to ensure reliable streaming. We are not liable for stream interruptions caused by venue internet infrastructure failures, power outages, ISP issues, or platform outages beyond our control. We carry backup cellular bonding equipment to mitigate risks.

9. Limitation of Liability

BOMCAS Media's total liability in connection with any service shall not exceed the total fees paid for that service. We are not liable for indirect, incidental, or consequential damages. In the event of equipment failure or unforeseen circumstances that prevent service delivery, our liability is limited to a refund of amounts paid.

10. Force Majeure

BOMCAS Media is not liable for failure to perform services resulting from circumstances beyond our reasonable control including natural disasters, severe weather, government restrictions, pandemics, or other force majeure events. We will make reasonable efforts to reschedule affected services.

11. Governing Law

These Terms of Service are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta.
